Algunas de las cuentas, aquellas que estan depositadas en fondos mutuos y en las cuales Stanford no tenia control directo y solo ofrecia asesoria deberias ser liberadas dijo Ralph Janvey, quien esta supervizando la situacion de Stanford por orden de la corte texana.
De acuerdo con Blumberg News estas cuentas deberian ser liberadas y devueltas a sus propietarios lo antes posible.
Feb. 24 (Bloomberg) — Some mutual-fund assets of Stanford Financial Group’s clients should be released from a court- ordered freeze for cases in which the firm only provided investment advice, said the receiver for the Stanford companies.
The mutual fund assets in question are held outside of Stanford’s custodial relationships with Pershing LLC and J.P. Morgan Clear Corp., the court-appointed receiver, Ralph Janvey, said yesterday in a statement on his Web site. They involve accounts in which Stanford only provided advice on investment strategy, according to the statement.
“These assets are typically held directly in the name of the client by a mutual fund,” the receiver said. “Stanford Group Company does not transact in these accounts, does not provide custody for these accounts, does not maintain books and records pertaining to the assets, and does not provide the client with individual transaction statements.”
Janvey, a Dallas securities lawyer, was appointed receiver as part of the U.S. Securities and Exchange Commission’s lawsuit filed Feb. 17 against billionaire R. Allen Stanford and three of his firms for allegedly selling fraudulent certificates of deposit. No criminal charges have been filed.
Pershing LLC, a Jersey City, New Jersey-based firm that handled Stanford accounts, told clients last week that they couldn’t retrieve their money from Stanford International Bank Ltd. because the court had frozen the accounts.
Kevin Sadler, an attorney for Janvey, didn’t immediately return an e-mail message seeking comment after regular business hours yesterday.
The case is Securities and Exchange Commission v. Stanford International Bank Ltd., 09-cv-00298, U.S. District Court, Northern District of Texas (Dallas).
